Trump Presidential Immunity: In a historic verdict, the Supreme Court decided that former President Donald Trump is partially immune from prosecution for official acts committed while in office.

The Supreme Court ruled, by a vote of 6-3, that all presidents, including the former one, are entitled to “absolute immunity” for acts that are taken in the exercise of their “core constitutional powers” and “presumptive immunity” for official acts taken while in office.

However, this immunity does not extend to actions outside their official duties. Chief Justice John Roberts, who penned the majority opinion, emphasized that Trump enjoys absolute immunity for his core constitutional powers but stated clearly that this immunity does not cover unofficial acts.

According to the court’s decision, Trump may still face charges for his non-official activity. Trump’s legal team is expected to leverage this ruling to challenge the evidence against him in all four of his criminal cases.

Considered a “major victory,” they hailed the ruling, saying it gives Trump more opportunities to defend himself in the two ongoing federal cases, his state prosecution in Georgia, and his conviction on 34 state felony charges in New York.

Delayed but Not Derailed

Trump’s federal criminal case about his efforts to rig the 2020 election is probably going to be postponed as a result of the ruling. Since December, the matter has been on hold as Trump claimed that presidential protection shielded his acts.

After the Supreme Court’s ruling, the lower court will have to decide which of Trump’s acts were authorized and which were not. This may take many months, delaying the trial until after the presidential election in November.

President Joe Biden denounced the ruling, describing it as a “dangerous precedent” that undermines the rule of law and does a disservice to Americans.

He made it clear that everyone is subject to the law, even the president. Trump, however, celebrated the ruling on his social media network, Truth Social, calling it a “HUGE WIN FOR OUR CONSTITUTION AND DEMOCRACY.”
